Job Description
JGM - Contracts
Responsibilities cover managing the execution of the complete Contracting Process including Contract Strategy, Tactics, Contract Award and Contract Management activities for the projects execution contracts with specific focus on PMC contract, installation contracts, construction Contracts and EPC Contracts.
During post award phase, the responsibility include maintaining the commerciality of these contracts, specifically management and settlement of variation and claims.
These responsibilities include accountability to manage:
- Internal (Nayara) stakeholders in development and execution of contract strategies/tactics driving towards value maximization in awarded contracts/commercial deals. [Pre-award Phase]
- Internal (Nayara) & External (Suppliers/Contractors) Stakeholders in ensuring delivery and protection of value under each of the contract, including leading negotiations and settlement of disputes. [Post-award Phase]
ACCOUNTABILITIES
ACTIVITIES
Developing Contracting Strategy & Its ImplementationTake inputs from the requisitioning departments, understand their requirements, and assess the market capability supporting the requirements.
Develop commercially competitive project sourcing strategies and tactics that meet the business requirement
Develop the pricing models in line with the strategy and scope,
Develop and finalize the tender documents based on the inputs provided by the technical teams / engineering consultants.
Liaison with legal, commercial, PMC and finance departments for finalising the terms & conditions.
Identify the vendors/contractors
Obtaining required internal approvals.
Floating tenders and completing the tendering process till award of work.Sign Non-Disclosure Agreement/ Confidentiality Agreement with Tenderers
Float the tenders in line with procedures and liaison with other departments for completing the tendering process.
Coordinating commercial/technical queries and their timely response.
Opening of Technical and Commercial tenders
Managing the tender evaluation process in a robust and professional manner
Leading commercial negotiation with the preferred tenderer
Ensure timely award of work on completion of the process including and signing of contract after obtaining required internal approvals.
Developing standard contracting processes and strategies including standard term & conditions,With the objective of standardising and improve the contracting processes, develop the processes, strategies, and vendor/contractor data base by adopting the best practices as well as lessons learnt.
Introduce KPIs in the Contracts and develop a feedback system for vendors/contractors for future reference.
Post award Contract ManagementDevelop Contract Management Plan for awarded contracts and ensure respective rights and obligations have been understood by Company Representative.
Provide contractual interpretation to user departments for contractual terms & conditions whenever required.
Change Order Management, Change Proposal Review and approval of change orders
Performance Management of Contractors ensuring there is no value leakage
Provide support during contract closing and in resolving the disputes, if any.
Developing Systems/ProcessLeverage Procurement systems to improve the process as well as deliver valuePeople Provides support and guidance to other team members to ensure delivery of results where possible.
